Abstract

This study is about the forming of Islamic law maxims in the book Mabsūṭ written by S̲h̲ams al-Aʾimma al-SaraKhsi, a Ḥanafī jurist of the 11th century,identifying his method in forming the fiqh maxims in his book, revealing the characteristics of the method in addition to extracting the Fiqh maxims which are used to discover the concepts or ideas of Imam al-SaraKhsi in forming the maxims and regulations of Islamic law. Imam al- SaraKhsi’s method in forming the Fiqh maxims is based on perfect, congruous and strong bases and principles which indicate the perfection and firmness of his method. The author’s method in deducting the evidence and extracting the meanings and reasons from the evidence indicate that he was a great scholar of Islamic law as well as Islamic jurisprudence and he has comprehensive knowledge about the method of extracting from the evidence.
