Conditions of Marital Accord: The Perspective of Shia Jurists

Abstract

Islamic teachings streamline all aspect of human life with a benign consideration. Same applies to the conjugal life. Islamic ideology of life has developed a comprehensive system for human beings to achieve their aspirations & sexual gratification. For this purpose institution of marriage is suggested with a comprehensive code.This code defines the eligibility and suitability of a person to marry other, for a valid Nikah; the marriage contract. On the other side, this code explains the conditions without which a Nikah cannot get legality. In this regard, the views and approaches of Shi’a jurists are noteworthy and significant as an interpretation of Islamic injunctions. Therefore, the following research paper explores the same. It must remain clarified that according to Shi’ah Imamia sect, Nikah Mut’a is also legal, on the other side, Sunni Fiqh declares it illegal.
